      Note: Samuel?s provision that his wife be the guardian of their minor children along with her father leads me to believe that a woman did not legally have that right at this time. Regarding the debts of his brothers James and Charles G., it is interesting that Charles seems to have moved to Alabama around this time and James seems to have lived in Alabama at some point because one of his sons was born there in 1829. James moved to Little Rock, Arkansas, by 1835, where he was a merchant and also involved with stagecoaches.

      The Last Will & Testament
      Samuel Pitcher
      Proved and recorded October 6th 1832



      The last will and testament of Samuel Pitcher of the City of Troy in the County of Rensselaer. First the said Samuel Pitcher considering the uncertainty of this mortal life and being of sound mind and memory blessed to Almighty God for ___ do make and publish this my last will and testament in manner following that is to say I give and bequeath onto my beloved wife Maria Pitcher all my personal property of every kind ___ and nature (subject to the payment of my just debts) for her support & for the support and education of my children Joseph Russell Pitcher & Elizabeth Russell Pitcher until the ___ Joseph Russel Pitcher shall arrive at the age of twenty one years or in case of his death until the said Elizabeth Russell Pitcher shall arrive at the age of twenty one years.



      Secondly when my son shall arrive at the age of twenty one years or in case he shall sooner die when my said daughter shall arrive at that age I give to my said wife to invest for her own use the sum of eight thousand dollars during her natural life then to be divided between my said two children when the oldest then living shall arrive at the age of twenty one years equally. If in case of the death of either to the surviving child & in case of the death of both of my said children before they shall arrive at said age then all my property shall go and belong to my said wife. And on the death of my said wife, my said children or the survivor of them shall have all said property.



      If they neither of them shall survive my said wife and in case my said wife should survive both my children & in case there should be any of my property remaining not divided or given to my children or either of them after they shall have arrived at the age of twenty one years aforesaid ____ by my said wife as aforesaid then such remainder if any shall at the death of my said wife & not before be divided between my four brothers James, Zina, Charles G. & Sidney or their legal representatives but the amount which this my will would give in such an event to the said James or Charles G. or either of them or their respective legal representatives is subject to the following condition that the respective share which in this event the said James & Charles G. would be entitled to shall be applied to the payment of any balance of debt exclusive of interest then remaining unpaid which is now due from them the said James and Charles G. respectively to Craft (?) Hart and Pitcher Southwick Cannon and Warren (?) Vail (?) & ___ son Eli L. Dibble or their legal representatives in proportion to the respective demands exclusive of interest the balance if any in this event after the payments of the last mentioned debts shall belong and be paid to the said James and Charles or their legal representatives. And I hereby appoint my beloved wife Maria Pitcher and my esteemed friend & father in law Joseph Russell of the city of Albany executrix and executor of this my last will and testament. And I hereby commit guardianship of my said children until they shall respectively attain the age of twenty one years to my said wife & to my said friend Joseph Russell & the survivor of them hereby revoking all former wills by me made. In witness wereof I have hereunto set my hand and seal this fourteenth day of March in the year of our Lord one thousand Eight hundred & thirty two.

      Be it remember that on the sixth day of October in the year of our Lord One thousand eight hundred and thirty two personally appeared before me Anthony Blanchard Surrogate of the County of Albany aforesaid Isaac McConike ?.. Whereupon the said will is admitted in due form to probate
    • Charles Pitcher's brother Zina Pitcher was a well-known doctor and politician who settled in Michigan. He helped to found the University of Michigan and was elected as the Mayor of Detroit, Michigan. The following is an excerpt from a speech published in Michigan Alumnus, Volume 14, University of Michigan Alumni Association:

      "An address delivered before the Medical Department on Founder's Day, February 22. Zina Pitcher, son of Nathaniel Pitcher, a captain in the revolutionary war, and Margaret Stevenson, a Scotch woman, was born April 12, 1797, on a farm in Washington county, New York. His mother, when he was but five years old, was left a widow with her three children, Zina, Sidney and Charles, and a stepson, Nathaniel Pitcher. Upon her devolved the task of providing a livelihood and a schooling for the four boys, out of the resources of a new farm. Several years later she married Solomon King by whom she had a son Benjamin, who was the father of Zina Pitcher King, now living in Ann Arbor. Notwithstanding the adverse and trying conditions which beset her, and with a singular appreciation of the value of education, the mother bent every effort to provide its advantages for her five children. How well she succeeded may be seen in the career of her stepson who, as General Nathaniel Pitcher, became Lieutenant-Governor of New York in 1826, and, on the death of Dewitt Clinton, in 1828, the Acting Governor of the State. The son, Sidney, died young and unmarried, while Charles married in the south, and his descendants, it appears, actively supported the Lost Cause."
